Before you can legally be charged with a DUI, the District Attorney must be able to show that you were driving a motor vehicle. This is usually proved by the police officer who actually observed you driving a motor vehicle. If not personally observed, then precipient witnesses, or circumstantial evidence comes into play. But it in order for one to get pulled over, there must be PROBABLE CAUSE. In other words, there must be some violation of the California vehicle code. Examples of such violations include: speeding, straddling lanes, failure to signal, failure to stop, tail lights not working, etc. In other words, a police officer cannot pull one over for no reason at all. Even though you were arrested, there are certain motions we can file on your behalf to get your case dismissed.
Once pulled over the police officer will go through a litany of questions and procedures. He will ask for your license, insurance and registration. But during the contact he will smell "a strong odor of alcohol" emitting from the driver. Thereafter he will ask you to do a series of "FST'S" ( Field Sobriety Tests). He may even ask you for a PAS (preliminary alcohol test). Then an arrest usually occurs at this point and you'll be taken to the police station. At the police station you'll be given an option for a breath test or a blood sample. Once you are cited out of jail, or bonded out, there will be a mandatory court appearance in your near future. There will also be the inevitable proceedings with the California DMV.
